Florida DUI Checkpoint Results - 1000 Stops - Zero Arrests for DUI
A Florida DUI checkpoint nets 10 arrests. But, none of them were for DUI! The Florida Highway Patrol set up the checkpoint. There were actually 1,131 vehicles checked.Here's the Tally:
Zero arrested for DUI
Two arrested on outstanding warrants.
Seven arrested on felony charges, including six on drug-related charges.
One arrested for misdemeanor drugs.
104 traffic citations issued.
10 faulty equipment warnings were issued.

Pinellas DUI Attorney on Big Brother and Cameras

Pinellas DUI Attorney spotted and photographed the latest addition to the Sheriff's Office "Big Brother is Watching" arsenal - two trunk-mounted Automatic License Plate Recognition Systems have now been installed on some marked (photo) and unmarked cars. The system has a camera on each side that optically character recognizes a license plate, then compares the license number to massive databases containing the license status of the registered car owner. According to Thomas M. Manson "Every now and then, a technology comes along that changes the way we do business. Automatic license plate recognition (ALPR) systems will revolutionize law enforcement procedure by providing officers instant information about their contacts via the automobile license plate."
It is expected that a single cop could process hundreds or thousands of plates per shift. The databases will be searched, including the FBI's NCIC database for wanted vehicles or plates, for stolen vehicles, for wanted felons, people with outstanding warrants, or outstanding traffic citations.
Manson reports, "Scott McCallum, system analyst for Pinellas County Sheriff's Department in Florida, manages data processing for several of his agency's ALPR units. He addresses its success at reading the variety of national plates, 'We can pretty much read any plate in the U.S. As long as it's a standardize[d] plate with a maximum of seven characters, we're not going to have an issue reading it.'"

Pinellas DUI Checkpoint Invalid
Pinellas DUI checkpoint was invalidated. The problem with this case is not with the Plan itself, but rather the lack of evidence that the Plan was complied with in conducting the traffic stop of the defendant. Competent substantial evidence is evidence ''sufficiently relevant and material that a reasonable mind would accept it as adequate to support the conclusion reached.'' See Department of Highway Safety and Motor Vehicles v. Trimble, 821 So.2d 1084, 1087 (Fla. 1st DCA 2002) (citing DeGroot v. Sheffield, 95 So.2d 912, 916 (Fla. 1957)).The Pinellas DUI checkpoint plan stated that it was to begin at 12:30 a.m. and end at 3:30 a.m.. The Police reports completed by the Deputy, stated that the defendant was placed under arrest at 12:35 a.m. after failing the field sobriety tests. The Deputy was not called to testify and there is no other evidence to refute the time of arrest. The court found that such an exchange would necessarily take longer than 5 minutes. Hence, the Court finds that the defendant was stopped before 12:30 a.m. in violation of the Plan.

Palm Harbor DUI - Oops
In a Palm Harbor, Florida DUI allegation, a suspect crashed into a Pinellas County Sheriff's cruiser according to the St. Petersburg Times in Florida.According to the reports, the suspect was northbound on U.S. 19 when he rolled up on a Deputy who was stopped at a red light, he hit the back of the cruiser. Cop was treated and released. The suspect voluntarily submitted to blood testing.

Seven Charged at Pinellas County DUI Checkpoint - Wolfpack
PINELLAS COUNTY DUI - According to Bay News 9, The Florida Highway Patrol charged seven drivers were charged with DUI during a recent operation. Other drivers received citations or arrests. The checkpoint was located on U.S. Highway 19 at Mainlands Boulevard.The next night, DUI Wolfpack officers on operated on Interstate 275 between the Howard Frankland Bridge and 58th Avenue North and along Gandy Boulevard between the Gandy Bridge and 66th Street.

Pinellas DUI Cops and False Reports
Pinellas DUI Attorney found that two Pinellas County deputies were suspended after making a false arrest report, according to an internal affairs investigation and the St Pete Times.The DUI cops conducted a traffic stop that resulted in a DUI charge and a window tint infraction. In court, the cop gave testimony that contradicted his arrest report. Further investigation revealed that the cop searched the vehicle without gaining consent, even though a report said he had consent.
In the same traffic stop, another Deputy made a false report. The internal affairs investigation says that cop lied in his report about reading the suspect his Miranda rights.

DUI Tampa Attorney - Checklist Checkpoints
Tampa DUI Attorney reports that a recent decision to deny motion to suppress evidence obtained during stop of defendant's vehicle at a sobriety checkpoint was an error. Court found where state did not show that the checkpoint met legal requirements to pass constitutional standards - case would be thrown out. The court reviewed Written guidelines for checkpoint and held them deficient. The standards left vehicle selection procedure to discretion of a field officer to develop a contingency plan on the spot in the event of a traffic backup. Case tossed because evidence showed that officers did not strictly adhere to written plan.

Florida DUI 100 Arrest Contest Winners

Pinellas DUI Attorney - Court Costs and Fines
Pinellas DUI Attorney Casey Ebsary reports that Judge William H Overton has announced the new minimum fines and Court Costs for Pinellas DUI cases. They are:$745.50 for a first offense,
$1,008 for a second offense (or 1st offense enhanced), and
$1,537 for a third offense (or 2nd offense enhanced).
