Florida Traffic Cameras - Florida Attorney


According to my friend an excellent traffic attorney, "From a legal standpoint, this decision seems to track the Minnesota Supreme Court decision which ruled that the State has exclusive jurisdiction for the creation of traffic regulatory laws.  Minnesota and Florida’s traffic code seem to be quite similar, so this would be predictable.  The [Third]  DCA is going to have to decide as to whether to maintain the integrity of this area of law, or provide a revenue stream for counties and municipalities."

Once the appeals are exhausted, the municipalities and counties will go to the legislature and ask for a law granting them authority to use these cameras.  When that happens, these tickets will be covered under [Florida Statutes Section 316] (they will carry points, and be required to be proven beyond a reasonable doubt).  Get ready to start defending these cases."
