Court cites privacy violations, tosses DUI-manslaughter verdict

An appeals court on Friday threw out the DUI-manslaughter conviction of a Sanford man, saying police took medical records -- including his blood-alcohol reading -- from a hospital without authorization.

The appeals court said she shouldn't have. Jurors should never have learned about Frank's blood-alcohol level because police "made no effort" to comply with state law, which is designed to protect the privacy of medical information, wrote appeals Judge Richard Orfinger.
